1) Acceptance of Terms

By accessing our website, submitting a form, texting/calling us, or scheduling service, you agree to these Terms. If you do not agree, do not use the site or services.

2) Website Use

  • Use the site only for lawful purposes and to request information or services from us.
  • Prohibited activities: scraping, automated data collection, spamming, introducing malware, attempting to gain unauthorized access, or infringing intellectual property.
  • We may modify or discontinue any part of the site without notice.

3) Estimates, Scheduling & Service Work

Estimates are free and non-binding until we issue a written work order/invoice and you approve it (signature/authorization by email/text is acceptable).

  • Pricing: may change due to site conditions, code requirements, refrigerant/material pricing, permits, or additional labor discovered on site. Taxes, disposal and trip/diagnostic charges may apply and will be disclosed on your work order.
  • Scheduling: we make reasonable efforts to meet requested dates/time windows but exact arrival times are not guaranteed (traffic, weather, emergencies).
  • Your responsibilities: provide safe access; ensure an adult (18+) is present to authorize work; safeguard pets/children; disclose known issues (electrical, structural, roof/attic safety, asbestos, mold, pests).
  • Excluded operations: we do not perform certain restricted or specialized work unless agreed in writing (e.g., unlicensed gas work, demolition, roofing or high-risk lift/crane work, or other exclusions per our insurance and safety rules).

4) Cancellations & Rescheduling

Please provide at least 24 hours’ notice to cancel or reschedule standard appointments. If our technician has been dispatched, a reasonable trip/diagnostic fee may apply. For larger projects, custom-ordered materials may be subject to supplier return policies.

5) Payments

We do not process online payments on this website. Payments are taken in person or by methods we provide directly (e.g., card, check, ACH, or approved financing). Invoices are due as stated on your work order. Past-due balances may accrue late fees as allowed by law. Title to parts/materials may remain with us until paid in full.

6) Warranties

  • Manufacturer warranties pass through to you and are governed by the manufacturer’s terms (registration, maintenance, proper use).
  • Labor warranty is only as stated on your invoice or service agreement.
  • Routine maintenance, filters, consumables, neglect, misuse, code changes, acts of nature, and pre-existing conditions are excluded unless expressly included in writing.
  • Except as stated, we disclaim other warranties (express or implied) to the maximum extent permitted by law.

7) Communications; SMS Terms

By submitting your phone number or contacting us, you consent to receive service and marketing calls/texts (including autodialed). Msg & data rates may apply. Frequency varies. Not a condition of purchase. Reply “STOP” to opt out and “HELP” for help. We may send important transactional messages (appointment reminders, service updates) even after an opt-out if reasonably necessary to complete your request.

8) Intellectual Property

The site (text, graphics, logos, photos, and other content) is owned by Gomez Solutions HVAC or our licensors and is protected by law. You receive a limited, non-exclusive, non-transferable license to view and use the site for personal, non-commercial purposes. No other rights are granted.

9) User Content

If you submit content (messages, reviews, images), you represent you have the right to do so and grant us a non-exclusive license to use it to provide the services and for customary business purposes. Do not submit unlawful, infringing, or harmful content.

10) Disclaimers

THE SITE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ANY INFORMATION IT CONTAINS. Field conditions vary; advice provided online/phone is preliminary until a technician inspects on site.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, OR LOSS OF DATA ARISING FROM OR RELATED TO THE SITE OR THESE TERMS. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE SITE WILL NOT EXCEED $100. For on-site services, liability is limited as stated on your signed work order or service agreement.

12) Indemnification

You agree to defend, indemnify, and hold Gomez Solutions HVAC harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site, your violation of these Terms, or your infringement of third-party rights.

13) Third-Party Services

Our site may include links or embeds (e.g., forms or scheduling) provided by GoHighLevel and other vendors. Their terms and policies govern their services. We are not responsible for third-party sites or services.

14) Governing Law; Venue

These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Hillsborough County, Florida for any dispute not subject to informal resolution.

15) Changes to These Terms

We may update these Terms at any time by posting a revised version with a new “Last updated” date. Continued use of the site after changes means you accept the revised Terms.
